Public Procurement

Since the adoption of the Public Procurement Act (PPA) in 2006, we have been consulting and soliciting our clients in the increasingly sophisticated regulations of this legal domain. We advise both contracting entities that organize and conduct procurement procedures, as well as private business clients tendering in procurement. We offer comprehensive legal services in the field of Public Procurement Act, including representation before the Commission for Protection of Competition (CPC) and the Supreme Court of Cassation (SCC), including:

  • Exploring, analysing and discussing with the client all options for participation in the called procurement procedure;
  • If you have tendered in a public procurement procedure and believe that the contracting authority is in breach of the Public Procurement Act or if you intend to tender in such a procedure, but you consider that the tender call and documentation contain discriminatory or other restrictive conditions that limit your tendering options, Georgiev & Partners is your best adviser on how to seek and defend your rights.
  • Drafting the client’s tender bid in a public procurement procedure or providing assistance in preparing the tender bid;
  • Verification of the client-provided tender bid as regards his/her tendering in the procedure under the Public Procurement Act;
  • Establishing a consortium or other grouping in order to meet all contracting authority’s requirements, registration in BULSTAT Register with the Registry Agency, if necessary;
  • Preparing translations, including by a sworn translator, providing legalization by the Ministry of Foreign Affairs of the Republic of Bulgaria;
  • Full client representation before the contracting authority in the different phases of the procedure;
  • Drawing up and filing a complaint before the Commission for Protection of Competition; Defence against a complaint filed with the Commission for Protection of Competition by a third party;
  • Drafting and filing a complaint with the Supreme Administrative Court (SAC) in appeal of Commission for Protection of Competition decisions regarding public procurement; Defence against a complaint filed with the Supreme Administrative Court by a third party;
  • Representation upon contract signing with the contracting authority, as well as providing the required documents for this purpose;
  • Litigation as regards the implementation of the public procurement contract before an arbitration tribunal or a court;
  • Legal services as regards the contract award execution; Litigation as regards the implementation of public procurement contracts before an arbitration tribunal or a court.
  • Consulting the Contracting Authority as regards the regulations for public procurement and the specific case law;
  • Consultation and representation of contracting authorities as regards complaints filed with the Commission for Protection of Competition and the Supreme Administrative Court;
  • Preparing tender documentation – preparation of complete documentation under the Public Procurement Act, including call for tender and the decision to open public procurement; Representation before the Public Procurement Agency;
  • Participation of a lawyer/economist/relevantly qualified professional in the commission in charge of the procurement procedure; Preparing documentation related to the commission’s work;
